Making a Will

It is essential for you to consider making a will to ensure that your estate passes to those who you wish to benefit from it. A will keeps you in control of your financial affairs after your death and further, can save your dependents from various problems to include tax issues. Further, if you wish to pass on specific gifts, for example, a gift to a  charity, cash gifts to a friend or a piece of jewellery to a specific child, you are able to do so in your will.

Probate is the legal process of dealing with a deceased persons estate and involves taking instructions from the executor of the deceased's Will (grant of probate) or the deceased's nearest relative/relatives when there is no will (grant or letter of administration), obtaining details as to the assets and liabilities of the deceased's estate and then making an application for either a grant of probate or a grant of letters of administration. 

Once the grant has been obtained, we will then deal with the collection of the assets of the estate, discharge all liabilities including the Inheritance Tax (if applicable), paying funeral expenses and distributing the assets pursuant to the terms of the will or in accordance with the rules of intestacy.

Power of Attorney - Wills and Probate Solicitors

A general power of attorney can be made by an adult appointing one or more persons to act on their behalf either generally or in relation to a specific matter, for example, the sale or purchase of a property. The power of attorney does not need to be registered but will automatically end if you cease to have the mental capacity or die. There are also special provisions in relation to a power of attorney which was made more than twelve months before it is being used. Courtyard Wills and Probate Solicitors can advise on the requirements to enable you to still utilize it.

Lasting Powers of Attorney - Wills and Probate Solicitors

Lasting Powers of Attorney (LPA) are documents whereby you give somebody the right to deal with your matters

People often wish to appoint someone to make decisions on their behalf or act for them should they not be able to do so themselves. This can be done by a LPA which enables a person who has capacity and is over 18 years old to choose one or more people to act on their behalf and make decisions for them if they themselves are unable to do so.

There are two types of LPAs: -

1. A property and affairs LPA is for decisions about your financial affairs such as selling your house.
2. A personal welfare LPA is for decisions about your health and welfare such as where you want to live and what medical treatment you do or do not want to receive.

The person you appoint as your attorney can make decisions as if they were you. They must act in your best interests. The LPA must be registered with the Office of Public Guardian (OPG) before it can be used. Until such time as it is registered, your attorney will not have any legal powers to make decisions or act on your behalf. You can register the LPA whilst you have capacity and the persons you appoint as your attorney can apply to register it at any time.

Inheritance (Provision for Family and Dependants) Act 1975 Claims - Wills and Probate Solicitors

This Act allows family members and dependents of a deceased person to make a claim from the deceased's estate when they consider that either they should have been left money by the deceased but have not been or that the provision for them in the deceased's will is not adequate.

Courtyard Wills and Probate Solicitors can act for the executors or administrators in defending such claims or alternatively for family and dependants wishing to make a claim. A claim under the Act must be made within 6 months of the date of the grant of probate or letters of administration although the Court does have power to extend this time limit in certain circumstances.
